By purchasing the TomaBelt from Toma Tiare, Inc., I am in full agreement of the following terms stated and described in the Purchase Agreement below.
I understand, and hereby agree that purchasing and conditioning with the TomaBelt is at my own risk. I acknowledge and agree I am voluntarily purchasing the TomaBelt from Toma Tiare, Inc. to use willingly, and of my own accord, while participating in any and all physical activities including dance, and I am assuming all risks of injury to myself on account of these activities, releasing Toma Tiare, Inc. from any and all responsibility for the use of the TomaBelt during my dance courses and/or any and all exercise or physical activity in which I voluntarily participate. I fully agree and understand that I voluntarily engage in physical activity including aerobic exercise and/or dance which may cause physical discomfort and injury to me. I assume responsibility for any potential injury caused by me, to myself, when engaged in physical activity, whether or not the TomaBelt is in use.
I, the purchaser, fully understand the TomaBelt is NOT for children under 18 years of age. By this purchase I hereby warrant, represent and agree that I am 18 years of age or older, or have obtained approval from my parent(s) or guardian(s) to purchase a TomaBelt, or my parent(s) or guardian(s) purchase the TomaBelt directly on my behalf.
It is further agreed that I am responsible for conducting my own physical evaluation, I may choose to consult / or not consult my physician prior to using the TomaBelt. Toma Tiare, Inc., its staff and/or employees will not conduct any evaluation on my physical condition, which may result in identifying risk factors contraindicating use of the TomaBelt and physical exercise prior to the start of my activity, and use of the TomaBelt in dance or exercise and/or any and all physical activity.
I, the purchaser, understand and agree to all guidelines and regulations of this purchase agreement. I agree, acknowledge, and understand that it is always advisable to consult a physician before starting a physical exercise program and/or before using any physical exercise equipment for use during exercise. It is my, the purchaser, responsibility to contact my physician or to personally determine my physical condition prior to using TomaBelt during any and all physical activity including dance in which I voluntarily participate.
By purchasing the TomaBelt I confirm and agree that I am in good physical health without any injury, physical disability, or illness preventing me from using the TomaBelt during any and all physical, dance, and/or aerobic activity. I voluntarily engage in any exercise or dance activity that may result in unfavorable, damaging or harm to my physical comfort and condition, health, safety or physical state and well-being. I, the purchaser, agree hereby to waive any and all claims or rights I may otherwise have against Toma Tiare, Inc. and/or the staff and/or employees of Toma Tiare, Inc. for any such injuries or claims aforesaid.
Because I have meticulously read this Purchase Agreement carefully, I agree and understand that it is a release of any and all future claims against Toma Tiare, Inc. for injuries or risk of injury resulting from voluntary dance and/or exercise and/or any and all physical activities while voluntarily using the Toma Belt.
An additional opportunity to read and review this Purchase Agreement is also available when purchasing a TomaBelt online. In order to complete the purchase transaction, I am required to review this information again, further agreeing to release Toma Tiare, Inc. from any liability should I decide to lend or provide the TomaBelt I purchased to those interested in sampling its use in dance or exercise activity.
Toma Tiare, Inc. is not responsible for my voluntary action to provide the TomaBelt to others who voluntarily request to wear the TomaBelt for their personal use during dance and/or any and all exercise and/or physical activity as this would be considered a voluntary act between me and others whom I provide the TomaBelt I own for their use in any and all physical activity including dance. I am assuming all risks of injury to those who borrow or use the TomaBelt I purchased, and provide for others to use or sample, releasing Toma Tiare, Inc. from any and all responsibility for any and all risk and injuries caused as a result of my voluntary action in providing the TomaBelt for others personal use.
I, the purchaser, assume all risks of injury to others whom I lend or provide the TomaBelt I purchased for their personal use in dance and/or any and all physical activity and/or exercise.
I agree and understand that Toma Tiare, Inc. reserves the right to change or modify these guidelines and regulations in the future without prior notification to the purchaser.
